Anthony issued a formal written response to the facts on DrKleinsmithFraud.com on approximately September 17, 2010. Thanks to the efforts of this site, Anthony has now corrected THREE of the thirty-one issues listed below that are discussed on this site. Check back here as we continue to track Anthony's progress. Corrected Points
Here is what Anthony has Corrected so far:
#1 Chatsworth College (see above): Anthony now admits that it was really "Chatworth College" (spelled with no "s"), which, though not completely ficticious, is completely phony.
#11 Fake Company (see above): After lying to customers for months, Anthony finally fixed this by renaming his company to Immune Tree, Inc. It had previously been named TBRL, Inc. in an apparent attempt to defraud TBR Labs, Inc.
#14 Just a Marketer (see above): Anthony tries to claim that he manufactures his own products, and in his reply letter states that his company "does the following at our Aspen Co Pak Facility...and has implemented all GMP." This is very deceptive. The Aspen Co Pak Facility is not theirs, and Anthony's company has not implemented GMP controls because it is not their facility. It is an independent company, a contract manufacturer. Anthony's site states: "What is the difference between Dr. Anthony Kleinsmith and Marketers? Marketers sell products to the public that are made by contract manufacturers." That makes Anthony just a marketer, by his own definition. Anthony shows some pictures of himself at his contract manufacturer's facility, but that does not make Anthony a manufacturer. UPDATE (10/01/2010): Anthony has removed from his site the false claim of being different from marketers that use contract manufacturers! It is, however, worth noting that his new wording is still somewhat deceptive ("We...contract manufacture..the product line.") given that they don't "contract manufacture" anything. They have product contract manufactured by third-party contract manufacturers. But we'll give Tony a break and say this is close enough to a correction since we appreciate honesty in even the smallest of steps.
Unsuccessfully Disputed Points
Here is what Anthony has Unsuccessfully Disputed so far:
#8 Fake Endorsements (see above): Anthony points to an early 2000s video featuring Dr. Donald Lein and Dr. Alfred Fox and uses their names without authorization in his advertising. Anthony tries to claim that this former relationship somehow constitutes an endorsement of his current product. Dr. Fox released an August 2010 letter to dispute Anthony's false claims, in which Dr. Fox states:
#15 Product Liability Insurance Lies (see above): UPDATE 09/22/2010: It had originally appeared that Anthony may have rectified the situation and finally purhcased a product liability policy. It turns out this is not the case. We encourage you to call the very person Anthony lists, Richard Nelson at Ultimate Insurance Services (801-794-0445), to verify for yourself. You will find out that neither Immune Tree, Inc. nor Anthony Kleinsmith have a policy. Aspen Co Pak does have a policy, and any Immune Tree, Inc. products manufactured by Aspen Co Pak would have some coverage for manufacturing errors. Products sold by Immune Tree, Inc. that are not manufactured at Aspen Co Pak (including chewables, LimuZ6 Plus, OxyQuest, etc.) would have absoluately no coverage under the policy. Furthermore, products that are manufactured at Aspen Co Pak are not covered for anything outside of manufacturing errors that occurred at the Aspen Co Pak facility. Anthony is leading stores to believe that Immune Tree, Inc. products are covered by insurance. In truth, only some products have any coverage, that coverage is limited, and the policy is held by a 3rd-party contract manufacturer.
#16 Failed Companies (see above): In his written rebuttal, Anthony claims to have "owned and worked for many successful operations" and provides a list of companies that are on our list. Every one of the companies he ran (excluding the new 2010 "Immune Tree, Inc.") has failed, usually resulting in severe financial hardship for those that invested in or supported him. How is that success?
#4 Cornell Researcher (see above): Though Anthony did not try to defend his lies about doing research for Cornell University, this official letter from Dr. Al Fox further supports our claim that Anthony is lying:
Conclusion
Anthony's lengthy written rebuttal touches on many issues addressed on this site, but dodges the facts. For example, since Anthony can't deny the facts of unethical and illegal actions by employees, he instead tries to distract the reader by talking about the employees' positive attributes. We don't doubt that his employees have positive attributes. Our contention is that some of them have crossed serious ethical and legal lines.
What it all boils down to is that Anthony's product pitch goes something like this:
The problem is that every one of those claims he uses to build credibility is completely false. Each of the claims has been thoroughly disproven on this site. This leaves absolutely no reason to believe his claims of product quality, and every reason to doubt him.
And that, folks, is exactly how Anthony has destroyed his own reputation, lost all credibility, and failed to convince others to join him.
